Smart Vent has been exhibiting at Insurance Agent conferences across the country and agents that are writing NFIP flood Insurance are already receiving calls from angry home owners that will be effected by the Biggert Waters Act (BW-12). If your not familiar with BW-12 attached is a summary of how it will be effecting the National Flood Insurance Program. The big change that will start taking place Oct 1, 2013 is the elimination of subsided rates, raising premiums by 25% a year until the property is rated at is actuarial risk, this will effect about 20% of the NFIP policies and there are over 5.5 million polices in-force across the county. Bottom line is that the BW-12 Act is eliminating breaks.

One of the first key steps in reducing risk thus reducing the premium is to obtain an elevation certificate. Because the majority of the homes receiving subside rates do not have EC’s you can expect the demand for EC’s to at least increase by 15% in your markets in some areas it may be over 40%.

As mentioned above agents are now scrambling to offer solutions to their angry customers frustrations of rising premiums, Smart Vent identifies risk and offers solutions to non-compliance by reviewing EC’s and then we connect the owner with a Authorized Installer. On average when Smart Vent retrofits the home and fixes any other non-compliance issues such as below grade spaces we reduce the premium for the home owner by 83% and provides them with a ROI in less then 2 years. With premiums on the rise the ROI will be even quicker. But again it all starts with the work you are doing in the field and the EC’s you are producing.

Summary of changes:

A significant milestone of the Biggert-Waters Flood Insurance Reform Act of 2012 (BW-12) is now upon us.  Beginning today, October 1, 2013, policies newly issued, assigned or reinstated after a lapse on Pre-FIRM properties in the Special Flood Hazard Area (SFHA) are subject to full-risk rating requiring an Elevation Certificate. In addition, policies newly issued or assigned on Pre-FIRM properties using the subsidized rate on or after July 6, 2012 (the date BW 12 became law) will face full-risk rating upon renewal on or after October 1. Further, policies that were allowed to lapse after July 6, 2012 and were reinstated after October 4, 2012 will face full-risk rating upon renewal after October 1.
 
Existing policies (issued originally prior to July 6, 2012) on Pre-FIRM properties which are primary residences may continue to be renewed using the subsidized rate until the property is sold to a new owner or the policy lapses. It is important, therefore, that agents, companies, lenders, and the policyholders themselves maintain an awareness of the timely renewal of these existing policies to avoid a lapse which may then trigger full-risk rating and the need for an Elevation Certificate.
 
At this time the NFIP's grandfathering and its extension of eligibility of the Preferred Risk Policy (PRPEE) procedures will continue as usual subsequent to October 1, however, the grandfathering of subsidized rates (Pre-FIRM properties in the SFHA or ZONE D and rated without an Elevation Certificate) will not be allowed to continue upon sale of a property or the lapse and subsequent reinstatement of a subsidized policy. We expect further guidance from FEMA on the possible impact to grandfathering and PRPEE from the future implementation of section 100207 of BW 12.

Biggert Waters Flood Insurance Reform Act of 2012 (BW-12) - Next Changes Coming Oct. 1, 2013
In 2012, U.S. Congress passed BW-12 which calls on FEMA and other agencies to make a number of changes to the way the NFIP is run. The new law eliminates some artificially low rates and discounts which are no longer sustainable. Most flood insurance rates will now move to reflect full risk, and flood insurance rates will rise on some policies. The most common solution will be to install flood vents to bring the building into compliance. See a description and timeline of upcoming changes here.
